Driving Law for Mobile Phones

On 27 February 2007 the new Road Safety Act 2006 came into force in the UK.

If you are using a hands free car kit and driving safely you will be protected from this new law.

You must not:
• Drive holding a mobile phone
• Supervise a driver while holding a mobile phone
• Cause or permit a driver to drive while holding a mobile phone

If you breach the law the new penalties are:
• 3 penalty points
• Fixed penalty notice fine increased to £60
• Cases dealt with by the court can incur a fine of up to £1,000
• (or £2,500 for drivers of goods vehicles, buses or coaches)

How does the law apply?

While driving, you will be breaking the law if you pick up or use any type of phone that is, or must be, held to operate it. For example, this means you may not use your mobile phone:

• when you are stopped at traffic lights;
• when you are queuing in traffic;
• to make or receive calls, text messages or to access the Internet.

Using Hands Free Car Kits

It is always an offence to not be in control of your vehicle, but if you do need to use your mobile phone whilst in the car, a professionally fitted hands free car kit is the best way to stay safe and avoid any fines or points on your licence.

You don't have to be caught many times to be disqualified. If you get just six points in the first two years after passing your test, you will lose your licence under the New Drivers Act.

If you are an employer, you can be prosecuted if you require employees to make or receive calls using a hand-held mobile phone while driving.
